The Administrator is a provider of health services in accordance with Act No. 372/2011 Coll., on health services and conditions for their provision, as amended.
II. Purposes of processing personal data
We process your personal data in particular for the purpose of:
provision of health services and maintenance of health records,
reporting of paid health services to health insurance companies,
billing of unpaid health services,
disclosing health information to you and other authorized persons,
organization of the provision of health services (ordering patients - in person, by phone, by e-mail or via a form on the website),
keeping accounting and tax records in accordance with legal regulations,
handling inquiries and requests sent via contact forms on the website,
protection of the rights of the administrator (e.g. in the case of debt collection or the exercise of legal claims).
III. Legal basis for processing
The legal basis for processing your personal data is in particular:
fulfillment of the legal obligation of the administrator (in particular Act No. 372/2011 Coll., Act No. 48/1997 Coll., Act No. 563/1991 Coll., Act No. 586/1992 Coll., Act No. 634/1992 Coll.),
performance of a health care contract, on the basis of which we provide you with health services (the contract does not have to be concluded in writing),
the legitimate interest of the administrator, in particular in protecting the rights of the administrator and in basic website traffic statistics (for essential cookies),
Your consent to the use of analytical and marketing cookies or to the sending of commercial communications (e.g. newsletter). You can withdraw this consent at any time.
IV. Recipients of personal data
The recipients of your personal data may be, in accordance with legal regulations, in particular:
other healthcare providers to whom the documentation is made available for the purpose of follow-up care,
health insurance companies,
public authorities and persons authorized to inspect medical documentation pursuant to Sections 31, 32, 33 and 65 of Act No. 372/2011 Coll.,
IT and accounting service providers who process personal data for us on the basis of a personal data processing agreement (e.g. providers of healthcare software, web hosting and accounting services).
We do not transfer personal data to third countries outside the EU/EEA.
V. Period of processing personal data
We process personal data contained in medical documentation for the period specified in Decree No. 98/2012 Coll., on medical documentation.
We process data for accounting and tax purposes for the period specified by applicable legal regulations.
We store data obtained through contact forms for the period necessary to handle your inquiry, but no longer than 1 year from the last communication, unless legal regulations require a longer period.
We store data processed on the basis of consent (e.g. marketing, analytical cookies) until consent is withdrawn or for the period specified for the given tool (typically 13 months for analytical cookies), unless a longer period is required.
VI. Your rights as a data subject
You have the following rights in connection with the processing of personal data:
the right to access personal data,
the right to correct inaccurate or outdated personal data,
the right to restriction of processing if:
you deny the accuracy of the personal data (for the period of verification),
the processing is unlawful and you request restriction instead of erasure,
we no longer need the data, but you require it for the establishment, exercise or defense of legal claims,
you have objected to the processing (pending the assessment of the objection),
the right to erasure (to the extent that we are not obliged to retain the data by law - does not apply to medical documentation),
the right to data portability (for data processed automatically based on consent or contract),
the right to withdraw consent at any time, if the processing is based on consent,
the right to file a complaint with the supervisory authority – Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.
You can exercise your rights in writing or by email to the administrator at the contacts listed above.
VII. Right to object
If we process your personal data based on a legitimate interest (e.g. essential functional cookies, protection of the rights of the controller), you have the right to object at any time.
In such a case, we will terminate the processing unless we demonstrate compelling legitimate grounds that override your interests or rights and freedoms, or unless the processing is necessary for the establishment, exercise or defense of legal claims.
VIII. Obligation to provide personal data
Providing personal data necessary for maintaining medical records is a legal requirement. If you do not provide it, we may not be able to provide you with healthcare, which may result in damage to your health or endanger your life (Section 41 of Act No. 372/2011 Coll.).
The obligation to provide personal data also applies to the patient's legal representative or guardian.
